About the Program

This panel will explore the damages available in copyright infringement cases; when actual and statutory damages are considered by courts, how actual damages are calculated, and instances when courts are most likely to award statutory damages.  It will explore how counsel considers damages when pursuing or defending a copyright infringement matter, as well as the in-house counsel perspective on damages.

New York Chapter Brown Bags are informal discussions on a range of copyright-related topics. In true brown-bag spirit, no food or drinks will be provided, so attendees are encouraged to bring their own. We keep the admission fee modest to encourage attendance by new or solo practitioners and law students, but all are welcome!


Brendan Kehoe
Global Head of Copyright and Trademarks, Bloomberg L.P.

Brendan is the Global Head of Copyright & Trademarks at Bloomberg LP. His group covers all matters relating to copyright, trademark, and digital brand enforcement for all Bloomberg businesses worldwide, including the Bloomberg Terminal (data licensing) and Bloomberg Media (news) divisions.  Brendan has deep knowledge and experience across a broad range of specialties, including developing IP asset portfolios, supporting strategic transactions, implementing brand enforcement and litigation initiatives, and establishing effective regulatory compliance programs. Brendan was previously in-house counsel with Pearson Education, Inc., where he helped resolve numerous copyright litigations and developed effective, forward-looking compliance programs. Brendan also worked in Kirkland & Ellis LLP’s Copyright, Trademark, Internet, and Advertising group, helping secure wins for clients including the Associated Press in the Obama Hope poster matter and The Tetris Company in copyright and trademark enforcement litigation.


Jessica Rose
Of Counsel, Quinn Emmanuel Urquhart & Sullivan LLP

Ms. Rose has extensive experience litigating intellectual property disputes in trial and appellate courts.  Her practice focuses on copyright, trademark, trade dress, false advertising, rights of publicity and “hot news” misappropriation.  Ms. Rose also practices before the Trademark Trial and Appeal Board of the United States Patent and Trademark Office. Ms. Rose’s practice often involves cutting-edge issues in copyright and trademark law. Capital Records, LLC v. Vimeo, LLC established, inter alia, that the Digital Millennium Copyright Act’s “safe harbor” provision shields websites like Vimeo from liability when users post videos that include pre-1972 sounds recordings. Pro-Football, Inc. v. Blackhorse concerned whether the Section 2(a) of the Lanham Act—which prohibits the registration of trademarks that “may disparage”—is unconstitutional. Apple, Inc. v. Samsung Electronics Co., Ltd. involved the proper scope of protection for product configuration trade dress, among many other issues.  

James Donohue
Charles River Associates

James J. Donohue is a vice president with Charles River Associates, a global business, financial, and economics consulting firm. Mr. Donohue has served as a financial consultant for more than 25 years in a wide range of areas, including damages, valuation, and forensic accounting. He has provided expert testimony in federal, state, and bankruptcy courts, as well as in various arbitration venues, including the International Chamber of Commerce and the American Arbitration Association. He has participated in all stages of the investigation and litigation process, including providing expert testimony, evaluating liability and damages claims, assisting in the preparation of complaints, assistance in depositions, trial/arbitration support, and the filing of expert reports. He has extensive experience in intellectual property litigation, valuation, and transactions. Mr. Donohue's experience with intellectual property litigation has included assisting clients in assessing damages in patent, trademark, trade secret, and copyright disputes. He has assisted clients with various intellectual property strategy and licensing engagements, including valuation and strategic consulting for tax, financial reporting, transactions, and bankruptcy proceedings. His work has included managing licensing and other intellectual property monetization engagements, including private auction patent portfolio sales. His valuation experience has involved a wide variety of industries, ownership interests, and asset classes. Mr. Donohue has performed numerous valuation engagements involving intangible assets and businesses for transaction, litigation, tax, bankruptcy, and financial reporting matters. Mr. Donohue’s forensic experience includes various accounting and financial investigations. His role in these engagements has included investigations and expert testimony. Mr. Donohue is a Certified Public Accountant and has a Bachelor of Science degree in Accountancy from Villanova University. He is also a Certified Valuation Analyst and is Accredited in Business Valuation.
